Voluntarily surrendered dental license after being convicted multiple times of a DUI.
On or about January 13, 2020, after pleading nolo contendere, Richard Swanson was convicted of one misdemeanor count of violating Vehicle Code section 23152, subdivision (a) [driving while under the influence of alcohol] with charged enhancement that he had a blood alcohol content of 0.15% or greater within the meaning of Vehicle Code section 23578 in the criminal proceeding entitled The People of the State of California v. Richard Brian Swanson (Super. Ct. Inyo County, 2020, Number CRTR-2019-64666-1). The court placed Swanson on three years’ probation, with terms and conditions. The circumstances surrounding the conviction are that are on or about October 1, 2019, an officer initiated a traffic enforcement stop after observing Swanson’s vehicle traveling in excess of 80 miles per hour. While speaking to Swanson, the officer could smell the odor of alcohol emitting from his vehicle. Swanson was observed to have red watery eyes, slurred speech, and had extreme difficulty standing while maintaining his balance. While at the scene, Swanson submitted to a series of field sobriety tests which he was unable to perform as indicated. During the booking procedure, Swanson provided a breath test that revealed an alcohol content level of 0.27% on the first reading, 0.23% on the second reading, and 0.25% on the third reading.
On or about November 8, 2017, after pleading nolo contendere, Swanson was convicted of one misdemeanor count of violating Vehicle Code section 23152, subdivision (a) [driving while under the influence of alcohol] in the criminal proceeding entitled The People of the State of California v. Richard Brian Swanson (Super. Ct. L.A. County, 2017, Number 7VV02248). The court ordered Swanson to complete a nine-month first offender DUI program, and placed him on 36 months’ probation, with terms and conditions. The circumstances surrounding the conviction are that on or about August 11,2017, Swanson was involved in a traffic collision. While speaking to Swanson, the officer could smell the odor of alcohol emitting from his breath and person and he was observed to have bloodshot watery eyes. While at the scene, Swanson submitted to a series of field sobriety tests which he was unable to perform as indicated. During the booking procedure, Swanson provided a breath sample that revealed an alcohol content level of .33%.
